US judge prevents Trump from suspending “parole” programs of Biden’s time

An American federal judge has again inflicted Trump administration efforts to end a multiple parole program in the multiple era for hundreds of thousands of Migrants from Afghanistan, Latin America and Ukraine.

The Judge of the North -American District, Indira Talwani, of Massachusetts, ordered on Wednesday that the Trump administration would resume applications for processing for migrants seeking labor permits or renewing their state.

Talwani, appointed former President Barack Obama, rejected the Trump administration’s statement that suspending probation programs was in his extensive discretion to direct immigration policy.

Federal legislation still requires the agencies of the United States National Security Department to follow a long process of granting or denying probation and other immigration relief, he wrote in relating to migrants who pursue a class action demand.

Talwani also certified a national class, temporarily protecting all individuals in various humanitarian parole programs while the case continues.

“This court, as in its previous order, emphasizes that it is not in the public interest to manufacture a circumstance in which hundreds of thousands of people will be made, for several months, they will be presented illegally in the country, so that these people cannot work legally in their communities or provide their own and their families,” the judge wrote.

“It is also not in the public interest to the people who enlisted and currently serve the United States Army to face family separation, particularly when some of these individuals joined the army in part to help their loved ones obtain a legal status.”

Some of the applicants were sentenced to the United States after working with the North -American military as translators.

The migrants received a two -year parole for living in the country in the programs established by former President Joe Biden. The programs let the migrants and their immediate family members fly to the United States as long as they had sponsors in America. Then they would be released on probation for two years.

However, the Trump administration has sought to end all the probation programs as part of its immigration repression and has already asked the Supreme Court to weigh on this subject. President Donald Trump signed an executive order on January 20 leading the Government to end “all categorical parole programs” established during the Biden administration.

Last month, Talwani blocked the administration’s efforts to revoke probation and mass work authorization for Migrants in Cuba, Haiti, Nicaragua and Venezuela, feeling that these actions required case determinations.

Anwen Hughes, a lawyer for the human Right First plaintiffs, said in a statement that they are satisfied with the sentence.

“This ruling reaffirms what we have always known to be true: our government has a legal obligation to respect the rights of all the beneficiaries of humanitarian probation and the north -Americans who have welcomed them in their communities,” said Hughes.

“We share the judge’s hope for the Government to adhere to this order and immediately resume the award of our customers’ relief applications.”
